Driving while texting is illegal, but walking and texting is still legal.
A Staten Island teen trying to text while walking fell into an open manhole - and city officials have launched an investigation. Alexa Longueira, 15, was walking with a friend along Victory Blvd. on Wednesday when she suddenly dropped underground. "She's all scraped up on her back, under her arms and her shoulders," her mother, Kim Longueira, said. The schoolgirl had just been passed the phone by her friend and was opening it to send a text message when the ground beneath her feet disappeared. The manhole had been opened by a Department of Environmental Protection team flushing a high-pressure sewer line, officials said. DEP has said an investigation is underway. "We regret that this happened and wish the young woman a speedy recovery," spokeswoman Mercedes Padilla said.

I was struck by the dismissive nature of your July 2 editorial, “Texting while driving only part of problem.” Anyone who drives regularly can tell you they have at some time or other seen someone drive erratically due to texting while driving. The number of crashes and deaths directly and indirectly linked to texting while driving has necessitated action. As a parent of one teenaged driver (who, by the way is a very responsible driver) and two others waiting in the wings, I know how texts are continuously sent and received. I am happy that there is one little thing — fear of a ticket — to hopefully keep my sons and other drivers that much safer on the road. It is often hard to detect people who do not wear seat belts, children who are not properly in car seats, speeders, or even drunk drivers. We certainly cannot have cops on every corner at every moment catching every infraction. That said, they are dangerous behaviors that put lives at risk, and laws have been an important part of cutting each of these practices. The same goes for texting while driving. The clear logic of this led to nearunanimous support in the over-15 counties that have passed this ban. Editorials from across the state, including the Watertown Daily Times, Post-Standard and Buffalo News, among others, have agreed that the ban is a logical step to saving lives, not just an emotional flair as the recent Gazette editorial implied. In fact, [last] Sept. 15, even the Gazette stated that the text messagingwhile-driving ban was a “textbook care of a law that shouldn’t be necessary, but is.”
