More than half care home residents denied basic care, unpublished data shows

More than half of elderly and disabled people in care homes are being denied basic health services while staff are failing to to do enough to preserve their dignity, according to an official review.



Some older people routinely have to wait up to three months for formal checks for painful conditions such as bed sores, according to figures from the health care watchdog.

A quarter were not given a choice of male or female staff to help them use the lavatory and more than a third of care homes surveyed admitted delays in getting medication to residents.

Campaigners blamed NHS bureaucrats showing a “lack of interest” and failing to provide expert assessments for conditions as basic as incontinence.

The findings emerged after almost 1,000 elderly people yesterday descended on Parliament to lobby their MPs calling for a radical overhaul of the social care system.

Paul Burstow, the care minister, signalled that a widely anticipated white paper of the future of social care had been delayed until next month insisting: “Getting it right is better than rushing it out and getting it wrong.”

Among those who addressed the crowd was the actor Tony Robinson, an ambassador for the Alzheimer’s Society, who said it was an “undeniable fact” that the system of social care is now in crisis with millions of people faced with paying large sums for care unlikely to meet their needs in old age.

The Archbishop of York also threw his support behind the lobby. Speaking during a visit to a care home he called for an overhaul of the care system to provide “dignity and peace of mind” to older people.

Fresh evidence of the failings in the system was detailed as a raft of previously unpublished data gathered by the health care regulator the Care Quality Commission (CQC) was released.

It was drawn from the first ever nationwide review of how the needs of needs of care home residents across England are met.

The CQC report discloses that people suffering from incontinence have to wait more than two weeks for an assessment of their condition in almost 40 per cent of homes for the elderly surveyed.

But a separate detailed analysis of the CQC data carried out by the British Geriatrics Society, also found that more than 40 per cent specialist providers set themselves a target as long as 90 days to carry out such assessments.

Such delays have led to elderly people being denied the treatment they need or forced to wear incontinence clothing when they do not need it.

The CQC research also says that 30 per cent of nursing homes investigated had no clear policy on when to attempt to resuscitate patients who suffer a serious deterioration in their health.

In a quarter of homes, staff admitted they were unsure about the health care needs of those in their care.

The Geriatrics Society study showed that only 57 per cent of Primary care trusts ensure that all elderly people under their responsibility have access to key services including continence assessments, physiotherapy, pressure sore checks and mental health services.

In 40 per cent of cases trusts set no specific targets to ensure the services were being delivered.
The society concluded that this showed the PCTs had “limited interest” in services for care homes.

Its president, Prof Finbarr Martin, said: “What it shows is that there is a massive disconnect between what the NHS aspires to and what it actually delivers to people in care homes and they are the most vulnerable group of people.

“The issue is there is a negative about people in care homes. There is a nihilism about care homes that is completely unreasonable and unjustified.”

Michelle Mitchell, director of Age UK, said: “The majority of people living in care homes have profound and complex health care needs.

“The British Geriatrics Society’s CQC data analysis reveals that many thousands of residents are failing to receive basic geriatric and community health care from the NHS.

“Older people who live in care homes should have the same rights to NHS care as anyone else.”

A spokeswomam for the Department of Health said: "This report is a snapshot of care in 2010. It gives some important pointers for the 500 dignity inspections CQC will be conducting of care homes this year.

"Improving medicine management in care homes is a priority for the Government.

"The Government is determined to spotlight and root out poor undignified care."

In a letter to The Daily Telegraph today, the heads of a string of charities including Age UK voice their support for a move in the House of Lords to protect the human rights of all elderly people receiving care.

Tea Party supporters rallied Saturday in Washington to oppose President Obama's government health care law, two days before the Supreme Court considers the constitutionality of the legislation.
"We want our freedom back," former GOP presidential candidate Herman Cain told hundreds of ralliers standing in the rain in Upper Senate Park, a few hundred yards from the steps of the Supreme Court. "That's what this is about, the freedom to choose our own doctors … the freedom to choose our own health insurance plan."
Cain also said that he might not have survived his battle with cancer under the new law had "some bureaucrat" learned he had only a 30 percent chance of survival.
"Stay inspired," he said, urging the crowd help defeat Obama in November.
"ObamaCare is a cancer in our government, and we’re going to rip it out," said Jenny Beth Martin, national coordinator of the Tea Party Patriots, which sponsored the "Road to Repeal" rally.
The rally largely marks the big return to Washington for the Tea Party, a loose organization of grassroots groups that helped conservative Republicans take over the House in the 2010 wave election.

49 States Already Implementing Parts Of Health Reform

– 12 states: Connecticut, Hawaii, Iowa, Maine, Maryland, Nebraska, New York, North Carolina, North Dakota,
South Dakota, Vermont, and Virginia—passed new legislation or issued new regulations that addressed all 10
of the reforms: expanding dependent coverage for young adults up to age 26, prohibiting lifetime limits on
health benefits, phasing out annual dollar limits on health benefits, prohibiting preexisting condition exclusions
for children under age 19, prohibiting rescissions (cancelling insurance, except in cases of fraud or intentional
misrepresentation), covering preventive services without cost-sharing, expanding coverage of emergency
services, allowing choice of primary care provider, allowing choice of pediatrician, and allowing access to
obstetricians and gynecologists without a referral.

– The District of Columbia and 11 states: California, Delaware, Indiana, Louisiana, Michigan, New Hampshire,

The Supreme Court hearing Tuesday on the controversial federal health care law will be one for the history books.
After presumably clearing away a technicality which was the focus of the in-the-weeds opening day, the justices are getting down to the indisputable linchpin of the entire health law challenge and the matter that will most likely end up making legal history.
Sandwiched on this week's Supreme Court docket of health care cases is Tuesday's examination of the individual mandate.
It's the provision in the law requiring Americans to buy health insurance. And it could unravel President Obama's biggest domestic policy achievement if it's struck down.

The issue on Tuesday will present the justices the opportunity to determine how much power the federal government has in forcing Americans to purchase a product or enroll in a government program they might otherwise avoid. Washington lawmakers have never before used this power. Some say that's because it's never been this necessary; others contend it's because the authority doesn't exist.
The justices will be looking at three significant constitutional areas to determine whether the Affordable Care Act (ACA) is lawful: the Commerce Clause, the Necessary and Proper Clause and the federal government's taxing power.

Mandatory health
insurance makes sense


    Re March 27 AP article, “Supreme Court opens 3-day health care overhaul review”: I’m so tired of hearing that compulsory health insurance is against the law.
    We are compelled by law to have vehicle insurance if we want to own and drive a vehicle, and this insurance not only covers the vehicle but also mandates a certain minimum for bodily injury.
    Banks require you to have insurance before they will give you a mortgage. So it appears your car and your house are considered more valuable than your body, since up until now there has been no compulsion to insure it.
    And do these businesses know something that those who are against health insurance for all don’t? Yes, they know that stuff happens but you never know to whom. So everybody shares the cost to help pay for the unpredictable and unfortunate. Sort of shared barn raising in days past, and a form of being your brother’s keeper for those who like a religious twist on things.
    You may get through life without your house burning or your car being in an accident, but I doubt anyone gets through without needing health care.
    So while the Supreme Court ponders their ruling on this, I hope it doesn’t go the way of Citizens United, where corporations were deemed to have the same rights as people and that decision is considered by many to be a mistake. But in any event, corporations don’t need health care.
    Also speaking of compulsions, education is compulsory to age 16 and everyone pays taxes whether they have children or not, and this continues your entire lifetime. It’s for the good of civilization.

You only need car insurance if you want to drive a car and mortgage insurance if you want to buy a house. How would you like it if you had to pay for part of my car and mortgage insurance when you didn't own either? The taxes you pay to schools is to the State/local government not the Federal government so if you don't like what you're being charged you can move to a more tax friendly state.
