Rotterdam Zoning Board of Appeals Agenda
Wednesday, July 18, 2012
1) Daniel Hosmer – 1054 Riggi Avenue, Rotterdam, NY, Tax Map #59.19-7-29 located in
the Single Family Residential (R-1) Zoning District. Petitioner respectfully requests that
she be granted variances as prescribed in the Town of Rotterdam Zoning Code being
Chapter 270-143 entitled “Fences.” Chapter 270-143(A)(1) sets a front yard height limit
at four (4) feet. The applicant would like to install a six (6) foot high stockade fence,
which would require a variance of two (2) feet. Chapter 270-143(A)(4) states that front
yard fences should be less that fifty percent (50%) solid or opaque. The applicant would
like to install a six (6) foot high stockade fence that is one hundred percent (100%) solid.
Property is a corner lot.
2) Nikki Moule – 1210 Countyline Road, Rotterdam, NY, Tax Map #70.00-3-16 located
in the Agriculture (A-1) Zoning District. Petitioner respectfully requests that she be
granted variances as prescribed in the Town of Rotterdam Zoning Code being Chapter
270-138 entitled “Accessory Structures and Uses.” The applicant would like to construct
an 18’ x 30’ addition and a 10’ x 14’ covered storage area onto an existing 16’ x 24’
detached barn in the rear yard of an existing single family residence. The variance
request(s) are as follows: Chapter 270-138(c) “Lot Coverage” states that the floor area
of any accessory structure shall not exceed 15% of the total habitable floor area of an
existing or proposed principal structure in the A, RA, R-1, R-2 and R-3 Districts. The
existing single family residence is 768 square feet which would allow an accessory
structure of 115 square feet. The proposed two additions will add an additional 680
square feet to the existing 384 square foot barn making the accessory structure a total of
1,064 square feet, which is 949 square feet over the allowed size of 115 square feet.
3) Larry Martinelli (Contract Vendee) – 1980 Evergreen Avenue, Rotterdam, NY, Tax
Map #58.11-5-12 located in the Single Family Residential (R-1) Zoning District.
Petitioner respectfully requests that he be granted variances as prescribed in the Town of
Rotterdam Zoning Code being Chapter 270-31 entitled “Lot area.” Chapter 270-31(A)
states that the required minimum lot area shall be not less than 15,000 square feet, with a
lot width of not less than 100 feet. The applicant is proposing the construction of a single
family residence on an existing lot that is 9,000 square feet in size with a lot width of 72
feet. This will require variances of 6,000 square feet for lot size and 28 feet for lot width.
4) Michele and Raffaela Viscusi – 145 Fabian Drive, Rotterdam, NY, Tax Map #58.15-
2-28 located in the Single Family Residential (R-1) Zoning District. Petitioners
respectfully request that they be granted variances as prescribed in the Town of
Rotterdam Zoning Code being Chapter 270-138 entitled “Accessory Structures and
Uses.” The applicant would like to construct a 16’ x 10’ addition onto an existing 19’ x
12’ detached shed in the rear yard of an existing single family residence. The variance
request(s) are as follows: Chapter 270-138(c) “Lot Coverage” states that the floor area
of any accessory structure shall not exceed 15% of the total habitable floor area of an
existing or proposed principal structure in the A, RA, R-1, R-2 and R-3 Districts. The
existing single family residence is 1,131 square feet which would allow an accessory
structure of 170 square feet. The proposed addition will add an additional 160 square feet
to the existing 228 square foot shed making the accessory structure a total of 388 square
feet, which is 218 square feet over the allowed size of 170 square feet.

Re: #1.  Law says 4' high and less than 50% opaque ... but they want 100% and 6' high.  

That, along with the rest of them, should be denied.  The law was put there for a reason.  If they're just going to grant variances without regard to neighbors or existing law, why not remove the law from the books and let people do whatever the hell they want?  Either that, or enforce the laws as they were written.
