Marco files claim against town
Fired employee says she’s owed final paycheck

    Fired Rotterdam Senior Center project coordinator Diane Marco said the town stiffed her on her last paycheck, even though she worked her regular 35 hours over a twoweek period.
    Marco has filed a small claims case against the town, demanding that it pay her the $517 that was withheld for her last week of work. She claims Town Supervisor Frank Del Gallo even signed off on her time sheet from her last week of work, but later only paid her for 3.5 hours of work, or roughly 14 hours less than she submitted.
    “How he got three and a half hours is beyond me,” she said Monday.
    Marco said she received notice from the town that she wasn’t approved for overtime hours. Though acknowledging that she worked different hours than normal in her final days on the job, she said she never submitted for any overtime pay.
    Marco’s claim recently appeared before Rotterdam Town Justice Kevin Mercoglin, who needed to recuse himself and have the case forwarded to a court without a judge on Rotterdam’s payroll. She said the town didn’t even send a representative to the court.
    During a brief interview in his office Monday, Del Gallo said Marco wasn’t told to work the time and therefore wouldn’t be paid for it. They'll pay her off, it's cheaper than sending the lawyers to court to fight it.

I can't believe DM is whining about something so trivial.  Guess it's s good thing she wasn't injured during one of those unpaid hours.

She still works full time for the City. And did the Senoir Center on top of the City job. When did she sleep? Another new low for the DEM town morons. The fact that they couldn't settle this out of court is disgusting.

She didn't care about the pay-lol. She did it for the senoirs! She have worked for nuthin but now she is suing to get hers? There's no bottom to this. Two more years of all DEM morons in Town Hall and it will be exactly like the City.

I can't even believe that this is even newsworthy!!

Did mason do some investigative reporting and dug this info up, or did DM call mason to give him this earth shattering story!!!
It's time for DM resign from the senior gossip center and 'join it'!!! Take a painting class, exercise, take your blood pressure!!!

Working together works but it sure don't pay! DM would gladly work for nothing but in the meantime is running to court to pick up her last check. What an embarrassment to the DEM machine. Another instance of fighting for scrapes at the lower end of the trough. And some want to expand this Senoir fiasco into an "intergeneration community center" on prime property on Curry Rd?

DM has never whinned she worked right till 2/28/2011 and the money that is owed to her is because she
worked for it. When you work you get paid. FDG called it overtime but it was not overtime it was the regular 35 hours worked in a
two week period. DM worked more overtime in the 14 months at the Sr. Center and
never asked for any additional money. She was paid $15k annually. The money that
FDG does not want to give her is only because he states because I said so just like everything else he has
done. It is called small claim court and FDG did not even show up on May 31, 2011 at 4pm at the Rotterdam Town Court in front
of Judge Mercoglan. Again he does not want to abide with the law. FDG waste more of the tax payers money because "I said so".

Marco has done more in the 14months she worked at the Center than JD did in the 30 years he worked
there. JD was to busy trying to befriend all the Seniors to see what he could get from them!! A house, $$$
and whatever else that would benefit him.

FDG does not know what any employee does in the Town. He never directs any employee to work at any of
the jobs except the two employees at the Brass Rail they can come in when ever they want and leave when ever they want and still get paid.

Marco worked 23 1/2 hours at the City and 17 1/2 hours at the Town that totals 40 hours.
