So no super majority - no zone change.

That's right!

it depends if they count hands and feet/noses/weight or actual verbalization on the whole subject.....

there we only 3 "ayes"

the new problem comes with the issue of getting a law enforcement officer to issue a ticket on a town law violation - they are just to stupid to know they can

just because our town laws are given to ecode360 for safe keeping does not mean they are not town laws - dont fall for this excuse like the racetrack people did

also all town laws should be kept in the town law book by the town clerk as required ny NYS law

and town laws are no different from state law

if our police chief does not understand this he needs to depart

i'm sure we can find a senior with a firearm permit to be the police chief for 1/2 the price and get much better service

again your vote matters

ROTTERDAM
Consideration of project awaiting engineer’s report
Supervisor decided to forgo review others still sought
BY JUSTIN MASON Gazette Reporter
Reach Gazette reporter Justin Mason at 395-3113 or jmason@dailygazette.net.

Tom DeLorenzo has asked Rotterdam officials to withhold a decision on his controversial zone change request until the result of a town-designated engineer’s report can be reviewed.
Apparently unaware of the project’s status, board members argued at length over who decided to remove DeLorenzo’s proposed zone change from the agenda for their business meeting last week. They also questioned Supervisor Frank Del Gallo’s apparent decision to forgo a report from a towndesignated engineer reviewing the validity of DeLorenzo’s claim that he could construct a four-unit apartment building on the property even without the zone change.
DeLorenzo is asking to change 2.7 acres off Floral Avenue near Walnut Avenue from a mix of zoning to multifamily residential. Residents living in homes adjacent to the property have opposed the proposal, claiming the building would significantly reduce their privacy and diminish the values of their homes.
Initially, some board members expected to address DeLorenzo’s proposal during their regular business meeting last week. In anticipation of a forthcoming vote, board members Nicola DiLeva and Gerard Parisi both asked for a report they believed town-designated engineer John McDonald was preparing for the town.
But Del Gallo said he didn’t see a need to “waste taxpayers’ dollars” on creating a report. He said he was under the impression DeLorenzo wasn’t pursuing the zone change any longer.
“It’s all over with,” he said during the board’s agenda meeting last week.
Yet both Parisi and DiLeva pressed him for a report. Both indicated they had expected some kind of official recommendation from McDonald when they asked to hire an engineer last month.........................>>>>.....................>>>>.....................................http://www.dailygazette.net/De.....r01400&AppName=1

I don't think FDG was equipped for rotterdam's super. But the dems and cons dressed him up and sold him like the first loaf of sliced bread. Rotterdamians can thank both the dem and con parties for their mis-representation of the man. Rotterdamians should beware the next time they see a dem or con endorsed candidate.............BEWARE!!!

However.............It doesn't appear that FDG was 'pulling the wool' over on anything. It appears that he 'really' doesn't understand how things are done!

It is essential to the maintenance of a democratic society that the public business be performed in an open and public manner and that the citizens of this state be fully aware of and able to observe the performance of public officials and attend and listen to the deliberations and decisions that go into the making of public policy.  The people must be able to remain informed if they are to retain control over those who are their public servants.  It is the only climate under which the commonwealth will prosper and enable the governmental
process to operate for the benefit of those who created it.

This legislative declaration clearly sets forth the intent of the Open Meetings Law and the STATE's idealistic goals for LOCAL governement.

This zoning change is approved by the town board 3aye 2no

The petition is said to not have the required 20 percent to require the super majority

One needs 20 percent of ALL properties touching the combined parcels involved - not just the parcel the zone changes is requested for.

This issue is off to the planning commission - when do they meet????
