Plea agreement includes no jail time

    The Draper Middle School teacher arrested last month on a misdemeanor drug possession charge remains suspended with pay but has been offered a plea deal that would spare him any jail time.
    Kristofer Rose, 32, of Colonial Drive in Rotterdam, appeared Tuesday before Judge Rachel Krester in Albany City Court to answer the charge of misdemeanor seventh-degree criminal possession of a controlled substance. Rose is an eighth-grade English teacher in the Mohonasen Central School District.
    Rose was arrested May 23 after Albany police say he was acting suspiciously in his 1999 Plymouth Neon that was parked at the intersection of Broadway and North Ferry Street. He allegedly had one piece of crack cocaine in the car and a piece of paper with powder cocaine in his pocket.
    Dressed in a blue suit with orange and blue striped tie, Rose did not speak during the brief proceeding. He is represented by attorney Dennis Schlenker.
    Prosecutors have offered a deal of three years of probation in exchange for a guilty plea. “At this time, we’re not prepared to respond,” Schlenker said.
    Rose is due back in court July 16. He declined comment leaving the courthouse.

Next, when he gets out of taxpayer funded rehab in Florida, they will give him an award for "overcoming adversity."

When I coached soccer at Duanesburg High School, I was requried to undergo a background investigation.  I believe that it was only a
review of police records.  But, if the teacher is convicted of drug possession and use, this could impact future hiring decisions.

He probably will go to drug court.  That's all he needs.  I would not take him out of the classroom based on this offense.  Had they caught him selling it, he would be out.  Teachers are fingerprinted before they begin teaching.

you do relize that we pay a crack head's salary with our tax dollars??

what happens when he leaves his next piece of rock candy in his desk and a student finds it?  what happens when he starts stealing kids iphones and radios and cell phones for his next fix??

Littlesal--it was a 7th degree offense...cut him a break.  I have never done drugs or even smoked pot but this seems way too harsh.  I also worked to get the Rockefeller Drug laws revoked.  He made a mistake--show a little kindness.  You guys on this board are som damn righteous.  And btw, "zero tolerance" is always ok until it happens to you or your kid.

He will probably be given a raise and get promoted to Guidance Counselor.  This drug charge and stint in rehab is a resume builder.  He now has personal experience of the potential negative effects of drug use and how it doesn't affect the life of a tenured member of the New York State Teachers Union.

    The Mohonasen school district teacher arrested in May on a misdemeanor drug possession charge remains employed by the district and has been paid $23,000 since leaving the classroom.
    Kristofer P. Rose, 33, an eighthgrade teacher at Draper Middle School, was arrested May 23 in Albany after police said he was acting suspiciously in his 1999 Plymouth Neon that was parked at the intersection of Broadway and North Ferry Street. He allegedly had one piece of crack cocaine in the car and a piece of paper with powder cocaine in his pocket.
    Rose, who lives on Colonial Drive in Rotterdam, was charged with seventh-degree criminal possession of a controlled substance, a misdemeanor. He had been offered a deal of three years of probation but he declined. Rose’s attorney, Dennis Schlenker, has fi led a motion to suppress evidence in the case. A hearing is scheduled for Feb. 2 at 2 p.m. in Albany City Court.
    Rose remains on administrative leave with pay, according to district spokeswoman Adrienne Leon. “We have an internal investigation going on. Until that investigation is concluded, we are obligated by law to maintain his employment,” she said.
    Leon could not say at point the district was in the disciplinary process nor when the internal investigation would be fi nished.
    School officials had said previously that they did not believe there was any drug activity at school involving Mohonasen students or staff members.
    Leon also could not comment on the specific circumstances under which Rose could be terminated. “There’s a variety of scenarios that could play out here. I don’t want comment on a specific situation.     The Mohonasen school district teacher on paid leave since being arrested last May on a misdemeanor drug charge was in court Thursday, with his attorney arguing that his client was not properly notifi ed of his rights and any evidence collected should be inadmissible.
    Kristofer P. Rose, 33, an eighthgrade teacher at Draper Middle School, was arrested May 23 after police said he was acting suspiciously in his car, parked at the intersection of Broadway and North Ferry Street in Albany. He allegedly had one piece of crack cocaine in the car and a piece of paper with powder cocaine in his pocket.
    Rose, who lives on Colonial Drive in Rotterdam, was charged with seventh-degree criminal possession of a controlled substance.
    The probable cause hearing in Albany City Criminal Court centered on the chronology of how Rose was stopped and what happened afterward. Officer Bret Phillips testified that he was working an overtime shift when at about 5:48 p.m. he noticed Rose slouching down in his seat and moving his hands toward his waistband.
    Phillips did a U-turn, pulling up beside Rose’s car and asking him his name and where he was going. Rose told the officer that he had been painting with a friend and was going to a nearby bar to meet up with a friend.
    Phillips asked for Rose’s identification and he did not have it. He then told Rose to exit the vehicle and asked him further questions.
    “He was pretty evasive in his answers,” Phillips said.
    Phillips asked if he could inspect the car and Rose said no. Phillips looked in the car and saw on the driver’s side floor a plastic bag of the style used to package crack cocaine. Do you think that if I went over to the school parking lot and acted suspiciously that the police might be called to check out what I was doing? Why should he be any different?

Because he was legally parked on a public street near several businesses during business hours and was doing NOTHING that could be even vaguely construed as suspicious when the officer first spotted him. The implication here, if I'm not mistaken, is that the guy was jerking off. Unfortunately for the moron cop, he didn't cite the guy with indecent exposure, which would have at least given him a legal leg to stand on for a search. Absent that justification for his u-turn(i.e., spotting criminal behavior), there's NO probably cause here for him to even approach the vehicle. If this search was justified, then a cop could pretty much walk by the window of your home, see 'something suspicious' and then use that as justification to search the place.

Betcha anything he gets off...no pun intended.

           Seems to me like the issue here is that someone guilty may get charges dismissed (wanted to say "off") on a technicality.  Bottom line is the cop caught the guy.  Story gets further compounded by the fact that the individual is a teacher.  So now the question is the suitability of this individual to be in a classroom, drugs, semi public lewdness, pornographic pictures of men/women.  What other "appetites" does this dude harbor??
