Spitzer’s DMV Commissioner, David Swarts, just finished up with some 4-1/2 hours of non-stop, intense, sometimes hostile questioning by the Republican-controlled Senate Transportation and Veterans, Homeland Security and Military Affairs committees.

While Senators repeated the concerns that have been voiced for a couple of weeks now: that this would allow terrorists into the country, it’s unfair to legal citizens, and that it was sprung on the state and local county clerks with almost no warning or input, one of the newer developments centered on the possibility that the Senate could stymie this whole plan by simply withholding funding needed to complete it.

That’s because the Phase II (Phase I has already started) entails money-requiring items such as creation of a special inspection unit to examine the passports that illegal aliens would use in lieu of Social Security numbers to get licenses.
Senator Tom Libous, R-Binghamton, for example, suggested they could still be in session in December ‘08, haggling over funding for the plan if the governor doesn’t re-think it. “It needs more thought. It needs more discussion,'’ said Libous, echoing other Republican opponents who urged Spitzer to hold back on the plan.

Address illegal immigrant issue, but not Spitzer’s way

   I am a legal immigrant, a naturalized American citizen, and from that perspective I will share my thoughts and feelings concerning Gov. [Eliot] Spitzer’s proposal to grant legal New York state driving licenses to illegal New York immigrants. You will notice that I use the term immigrants instead of aliens. “Aliens” evoke the image of little green folks with tentacles, saucer eyes, green skin etc. — creatures from Mars or Alpha Centauri — and I have not met any of those yet on our planet Earth.
   The governor should not be rewarding people for willingly breaking the law. And this is what illegal immigrants have done; they have broken the law. This sets a bad precedent. It is like telling the hungry that it is OK to break into grocery stores, the penniless to rob banks, the homeless to squat on other people’s property. Just because people are down on their luck or are striving for a better future does not mean they are immune to the laws of the very land they aspire to live in. And I can hardly be called antipoor or anti-immigrant.
   I don’t believe many illegal immigrants have ever driven or owned a car in their native countries, and the prospect of driving a car is not the foremost thought on their minds when they are trying to enter this country illegally.
   I am concerned about the way an illegal immigrant driver will react after an accident on the road — particularly of the tragic variety. Is he going to call the police, 911, the ambulances? Is he going to stay around to help, suddenly metamorphose into a law-abiding citizen or is he going to panic and flee, reverting to breaking the law?
   Vox populi, vox Dei [voice of the people is the voice of God] governor. What about a referendum — asking the people who voted you in power — what they think, what they want? You are not the only one with thought process in our state, even if you believe so. The “let them eat cake” government way of thinking went out with Marie Antoinette’s head centuries ago.
   I would be happy to see in place legal work programs for law-abiding foreigners wanting to come to this country to earn a living and better their lives. That would go a long way to help not only those deserving people, but also the American citizens who want, and need, their help. It is a needed system.
Let us do something to reward people who do the right thing. But, again, I have always been a dreamer.

   I supported and voted for Gov. Spitzer. I thought he would be strong proponent of financial responsibility. Heaven knows we need it. However, I cannot understand why he’s thinking of giving illegal aliens a driver’s license. What possible benefi t could it be to the people of this state?
   Having a valid driver’s license was a big deal when you turned 16; the first place you went was to motor vehicles to take your test. It was the best form of identification you can have. You can take out a loan, open a bank account, get on a plane and countless other privileges associated with possessing a valid drivers license.
   The governor is giving these illegals a free pass to all these benefits and more. Having a valid state driver’s license will mean nothing. As taxpayers, we are enjoying few privileges for the amount we have to pay to live here. If the illegals want a driver’s license, let them go through the process of becoming citizens, and then apply for the license.

EDITORIALS Spitzer must admit mistake, move on

   It seems doubtful, as some observers initially speculated, that Gov. Eliot Spitzer concocted his scheme to let illegal aliens get driver’s licenses as a way to divert attention from the “Troopergate” scandal, which damaged his reputation and threatened his political agenda. But the plan, not entirely without merit, has nonetheless managed to do so, and in a way the governor could never have intended. In short, it’s damaging his governorship as much as “Troopergate.” For his sake and the state’s, he needs to abandon it.
   The governor may love a good fight, and he certainly got one when Senate Majority Leader Joe Bruno — another renowned fighter — turned the tables on him with “Troopergate.” The damage caused by that scandal has been done, and there’s little Spitzer can do about it. But the furor over his licensing plan, which has become an equally distracting cause celebre for his political enemies, is a different story. All Spitzer has to do is say the word, and it could go away.
   Backing down in that fashion may not be in his constitutional makeup, but if he fails to do so soon, he could be a lame duck governor before even the end of his first year. Republicans, who are being invited onto national TV talk shows to savage the plan, smell blood in the water: They’re acting like demagogues, going so far as to encourage talk of recalling the governor. Inappropriate as that would be, it doesn’t seem that farfetched at this point.
   Spitzer doesn’t need this. New York doesn’t need this. There’s too much real work to be done, and Spitzer’s election was a clear mandate to do it. He squandered a lot of political capital with “Troopergate” and now with his alien licensing scheme, but he could get at least some of it back by calling it a mistake and jettisoning it.

How To Apply
When you apply for an identification card at your local DMV office, you'll need to fill out Form MV-44 (Application for Driver License or Non-Driver ID Card) and provide proper identification and proof of birth date.

You may get an ID card at any age, but applicants under 16 require parental consent. You may not have both a New York State driver license or learner permit and a non-driver photo ID card.

For applicants under 62, a short-term ID card is valid for four to five years and costs $9 to $10. A long-term ID card is valid for eight to nine years and costs $13 to $14. The DMV will issue you a temporary card when you apply, and your permanent photo ID card will arrive in the mail within five weeks. With the increase in requirements for public security, the DMV frequently updates the list of acceptable proofs of identity and date of birth. Carefully read the requirements described on this page. Make sure that you have the proof required before you apply for any DMV document.

If you apply for a driver license, a learner permit or a new non-driver photo ID card, and:

If you do not have a NYS driver license or or a NYS learner permit that is now valid or that was valid in the last two years, you must show proof of identity that equals a value of six points, your proof of date of birth and your Social Security Card (see Note 1).
If you do have a NYS driver license or a NYS learner permit that is now valid or that was valid during the last 2 years, you must only show proof of identity that equals a value of six points. You are not required to show your proof of date of birth or your Social Security Card.
See the list of proofs and their point values. One or more of your proofs must have your signature. Each document must be an original document or a copy of the original document certified by the issuing agency. You cannot use more than one document of a specific type for points. For example, three credits cards do not equal three points. They equal one point. The DMV does not accept any document with any alteration.  The DMV can confiscate altered documents and keep the documents for evaluation. The DMV will keep any document that appears fraudulent and can seek criminal prosecution against the person who used the document.

A suspended driver license or a suspended learner permit is accepted for proof of identity.

Note 1: If you are not eligible for a Social Security Card, you must provide a letter or form SSA-L676 from the US Social Security Administration (SSA) that states that you are not eligible. The SSA letter or form must have been issued no more than 30 days before the date of your application. You must also show the U.S. Citizenship and Immigration Services (USCIS) documents that the SSA used to determine that you are not eligible for a Social Security Card. The USCIS was formerly known as the Immigration and Naturalization Service (INS).
Note 2: If you did not provide a Social Security Number to the DMV for a previous transaction, you must show your Social Security Card with your application. If you are not eligible for a Social Security Card, use the instructions in Note 1.

Does anyone here think that this conversation is being brought up to stir up national debate over an OFFICIAL NATIONAL ID CARD??? Which can also be used to track national heath insurance, income, taxes, purchases and sales?????

no one/thing can protect us 100% from our neighbor(sex offender, drug user, alcoholic, schizophrenic etc) or any illegal immigrant.....you see, even if someone is here legally/natralized or otherwise, it certainly doesn't make me feel 'safer',entitled, owed or otherwise, or get any politician or 'fear agenda' my vote......

Group plans rally as GOP tries to block Spitzer plan

Richard A. Clarke, the former counterterrorism adviser to three presidents, on Friday endorsed Gov. Eliot Spitzer’s plan to make it easier for illegal immigrants to get driver’s licenses.
“States should act to register immigrants, legal and illegal, who use our roadways as New York is doing,” Clarke said in a statement to be delivered in a morning news conference with Spitzer in New York City.
   “From a law enforcement and security perspective, it is far preferable for the state to know who is living in it and driving on its roads, and to have their photograph and their address on file than to have large numbers of people living in our cities whose identity is totally unknown to the government,” said Clarke, who advised presidents George H.W. Bush, Bill Clinton and George W. Bush.
   Clarke is also the author of “Against All Enemies,” which claims the current Bush administration did not do enough to protect the country from the Sept. 11 attacks. Clarke also worked in the Clinton administration.
   With his endorsement, Clarke wades into political controversy that began after Spitzer announced regulatory changes he said will make streets safer by taking hundreds of thousands of illegal immigrants “out of the shadows.”
   Spitzer has met strong resistance from Republicans and many fellow Democrats who have said it would be a threat to national security and would allow illegal aliens to get identification that implies they are citizens.
   “Today Governor Spitzer continues to ignore the overwhelming opposition to his plan and is pushing ahead against the will of the people,” said Daniel Neumann of New Yorkers Against Driver’s Licenses for Illegal Aliens.
   The organization plans a rally Monday in Albany, when state Senate Republicans will try to block Spitzer’s plan. They are expected to get support from some Assembly Democrats.
   Spitzer has said many of those who oppose the plan don’t understand the decision, which includes new technology to verify foreignissued passports and other antifraud measures. He said the plan is consistent with recommendations of the 9/11 Commission.
   Earlier this month a Siena College poll found 72 percent of New York voters opposed the governor’s license plan. Twenty-two percent of those polled supported the plan of the once widely popular governor, according to the Siena Research Institute.
   Clarke said Spitzer’s plan, to begin in December, is needed before a federal Real ID license is implemented that could verify citizenship.
   The Real ID Act, passed in response to the Sept. 11 attacks, requires all states to bring their driver’s licenses under a national standard and to link their recordkeeping systems. States must verify identification used to obtain a driver’s license, such as birth certificates, Social Security numbers and passports.
   Driver’s licenses not meeting the standard won’t be accepted as identification to board an airplane or enter a federal building.
   CNN commentator Lou Dobbs has helped make Spitzer’s plan a national issue. Dobbs this week called the action an abuse of power that endangers citizens.
   “It’s hard to imagine what this governor is thinking and how he can possibly rationalize this,” Dobbs said in one segment. “Where is the morality in his obligation to fulfill his responsibility to citizens of the state of New York and certainly to uphold the law?”
   Republican lawmakers in New York claim Spitzer’s move violates the law.

The primary role of government is to ensure public safety.  Spitzer's decree does not support this end.

The Governor may find a few lone voices to support his position.  The polls of public opinion, however, indicate that
between 65% and 72% of New Yorkers oppose his order.  He was elected to represent his constituents.  His blatant
disregard of the wishes of New York residents speaks loudly to his priorities and loyalties.

The public must become active in opposition to Spitzer's decree to grant NY State drivers licenses to illegal aliens.
To this end, there is a rally being held at noon on Monday, October, 22nd on the steps of the State Capitol in Albany.  We need to establilsh a presence at this event.  Further, there are petitions being circulated to those who oppose Spitzer's order.  If you wish to obtain a copy and collect signatures, PM or e-mail me and I will get the document to you.  The signatures can be returned by mail or by FAX.
