If Marotta gets his special use permit IMHO it will just allow him to have a junkyard legally. Having old vehicles that leak gas, oil, and antifreeze over the aquifer recharge area should not be allowed under5 any circumstances.

I found this quote extremely amusing.

And I thought this quote summed it up nicely:  

“Essentially, you have an individual who is a scofflaw,” [County Attorney Chris Gardner] said Friday. “We’re trying to put as much pressure on him as legally possible.”

You know, I have to second Mr. Tommasone's remarks on this one.

It seems easy enough to get any zoning change you want in Rotterdam, if you just fill out a couple pieces of paper.  If Mr. Marotta just filled out these papers a few years ago, he wouldn't be looking at fines / jailtime and people would probably be fine with all this (not really, that's just a little cynicism coming through this evening).

Another thing we have to start worrying about is another place that construction vehicles seem to be congregating.  How about the Republican Club and all it's heavy equipment that continues to show up?

That's just up the hill from the aquifer, although maybe this is considered an OK place, since the Mobil that got moved from the aquifer is actually still closer to the aquifer than this land.

Funny you should mention the old republican club. I just went by there the other day and thought the same thing. WHAT A MESS IT IS!!

But I don't know how far the town wants to go with that one since I'm sure Larned is pi**ed about the defunct Walmart and now the defunct McLanes which I believe he was owner of part of that land. The guy just can't sell his land to anybody without the residents or the town officials putting a ca-bash on it.

But that republican club property is one heck of an eye sore!!

Schenectady County Leaders Praise Passage Of State Aquifer Protection Bill




Schenectady, N.Y., June 18, 2008 - Susan E. Savage, Chair of the Schenectady County Legislature today praised the State Legislature for passing new legislation that will protect sole source aquifers like the Great Flats Aquifer which provides high quality drinking water for Schenectady County residents.  The bill was passed during today's Assembly session following passage by the Senate last week.



"We are grateful to Senator Farley and Assemblyman Kavanagh for sponsoring this important legislation and we are very hopeful that Governor Paterson will sign the bill providing many new safeguards to our greatest natural resource in Schenectady County - the Great Flats Aquifer," said Susan E. Savage Chair of the Schenectady County Legislature.



Schenectady County has stepped up efforts to protect the Great Flats Aquifer in recent years.  After issuing the very first violation in the history of the Watershed Protection Board, the County found that aquifer protections at the State level were inadequate with a maximum fine for polluters of just $200.  The fines had not been updated in more than 50 years.



After discovering this shortcoming, the Schenectady County Legislature passed legislation urging the State Legislature to adopt stronger protections and worked with Senator Farley and Assemblyman Tonko's office to prepare legislation.  The bill was introduced last year, but it did not receive final approval.



Again this year, the Schenectady County Legislature, the County's Inter-municipal Watershed Board and local municipalities in the County passed legislation encouraging the State to enact tougher safeguards.



The Great Flats Aquifer is the sole source of drinking water for about 150,000 County residents.  The Aquifer currently has an excess capacity of more than 20 million gallons a day.



"If you think about it, nothing is really more important than a plentiful supply of water.  Many believe that after oil, the next great natural resource issue will be water and the communities blessed with abundant water supplies will be the leaders in the global economy.  In short, if we protect it, Schenectady County is in the enviable position of being a leader in providing clean water to our citizens and to our employers.  This legislation is all about protecting this great natural resource that we are blessed with in Schenectady County," said Savage.



The new legislation (S. 902 B/A. 9367 B) increases fines to $200 per day per violation. It also provides for increased fines and jail terms for willful violators and the ability of the courts to demand reparations from watershed polluters.



County officials will encourage the Governor to sign the aquifer protection legislation into law.

This is just in time...this weekend there's an open house for the new apartment complex that was just built on your water source.  Come start leaking the chemicals that might be dripping from your car without your notice or care into our water!  You know others will be doing the same.

Nice the way Susan Savage took all the credit for this one. If I recall correctly, it was initiated from the Rotterdam Town Board when it was and still is going through that Marrotta ordeal.

I think we also need to start worrying again about the Main Florist.  While they got most of the garbage out of there, there's still a dumpster full sitting on the ground there (sans dumpster).

Although I admire your concern regarding our aquifer, I don't think one dumpster is going to harm our drinking water. We already have a sprawl
mall, condo's, a chemical plant (si group)and more sitting on our aquifer already. Not to mention the paved roads with cars that leak oil and
gasoline that also endanger our aquifer. The damage has already been done over the past decades. Just with the si group alone, it is an accident   waiting to happen!!

You mean like the new high-rises with the cars with leaking products coming from the
engines every day / night right next door.  At the same time, this is not only garbage sitting
where your drinking water comes from, it's an eyesore...although it's quickly being overtaken
by weeds, so we won't have to worry about seeing it soon.

Let us not forget the pollution from the old tank farm on rte 5 in Scotia that has leached chemicals into the ground water as well.
